  1. SCOPE

These General Terms and Conditions (GTC) apply to all orders placed by customers via the online shop of LE MILK BAR, www.lemilkbar.com (hereinafter called LE MILK BAR). LE MILK BAR provides all services exclusively on the basis of these general terms and conditions. By placing an order, the customer expressly agrees to these General Terms and Conditions. These form an integral part of the contract between the customer and LE MILK BAR.

2. Information on the website & prices

2.1 All information on LE MILK BAR is subject to change and any liability is rejected. To the extent permitted by law, LE MILK BAR specifically excludes any guarantee and liability for the correctness, completeness and topicality of the information on the website.

2.2 We reserve the right to change prices and assortment at any time.

2.3 The current prices are published on the internet at lemilkbar.com

2.4 The prices are binding for both parties at the time the order is placed. However, in the event of mistakes or errors in the price indication, LE MILK BAR reserves the right to subsequently make price changes. In this case, the customer will be informed and is not obliged to accept the products affected by the price change.

2.5 All prices are in Swiss francs (CHF) and include statutory VAT unless otherwise stated.

2.6 In addition to the stated prices, the shipping costs expressly shown on the item page are incurred depending on the shipping method.

3. Order & Delivery

3.1 An order becomes binding for the customer when they confirm their order at the end of the ordering process by clicking on the 'Order with obligation to pay' button on the page on which the complete overview of the order is displayed.

3.2 Immediately after the order has been placed, the customer will receive a corresponding e-mail confirming receipt to the e-mail address provided by LE MILK BAR.

3.3 LE MILK BAR particularly reserves the right to reject an order if there is a legal dispute with the customer, in particular in connection with payments not made from orders already placed at LE MILK BAR, or if an invoice from the same person or a person living in the same household are still open.

3.4 The complete and correct specification of the delivery address is the responsibility of the customer. If the customer provides an incorrect delivery address, delivery may not be possible, LE MILK BAR can refrain from delivering the product entirely without any claims for compensation or damages being asserted.

4. Delivery and delivery time

4.1. The shipping policy stipulates that LE MILK BAR ships the product after 1-3 business days of receiving the order, provided there is confirmation of payment.

4.2 LE MILK BAR assumes no liability for delays in delivery and their consequences, including delays caused by the post office or third parties.

5. Discounts

A maximum of one discount can be redeemed per order. At the end of the ordering process, the discount code is entered in the field provided. The corresponding amount will be deducted directly from the current order. Discounts that exceed the order amount cannot be refunded. Discounts cannot be accumulated.

6. SHIPPING

Orders in Switzerland are shipped with Swiss Post (1-3 working days). Shipping is free in Switzerland.

International orders are shipped with Swiss Post (4-15 working days). International shipping is charged at a flat rate of 15 CHF. International shipping does not include duties. For detailed information about what duties or taxes may be charged, it is the customer’s responsibility to refer to their local customs website.

7. Disclaimer of Warranty and Liability

7.1 LE MILK BAR guarantees that the products are undamaged at the time of dispatch. Products that were damaged during shipping will be replaced at LE MILK BAR’s discretion, provided the customer notifies LE MILK BAR of the defect by email within 7 days of receipt of the goods. If LE MILK BAR so desires, the customer must also immediately return the delivered products to LE MILK BAR in the original packaging.

7.2 LE MILK BAR does not guarantee that the products are suitable for the customer's intended use or that they will produce a specific result. The warranty also excludes damage for which the buyer is responsible, for example as a result of improper use of the product, or damage caused by external influences for which the seller is not responsible, such as damage occurring during transport.

8. Right of Withdrawal & Right of Return

8.1 EU customers have the right to return the goods within 14 days after delivery of the goods. The right of return is exercised by returning the goods, a justification is not required. The customer must contact LE MILK BAR at hello@lemilkbar.com to initiate the return process.

8.2 Returned products or packages will only be accepted if they are in the correct condition, ie unused, unopened, undamaged and in their original packaging.

8.3 Exercising the right of return results in the conversion of the purchase contract into a rescission relationship, after which the services received under the purchase contract must be reimbursed. The customer bears the costs for the return.

8.4 After receipt of the goods, a purchase price that has already been paid will be refunded to the customer immediately. Shipping costs are non-refundable.  

9. means of payment

9.1 Orders via the LE MILK BAR website must always be paid in advance using the payment method specified on the LE MILK BAR website. The following payment methods are available: PayPal, credit card (Visa, Mastercard, American Express) and ApplePay. 

9.2 Until the products ordered have been paid for in full or the credit card provider has confirmed payment, the delivered products remain the property of LE MILK BAR in all cases.

10. PRIVACY

10.1 LE MILK BAR uses and processes personal data to maintain customer relationships and for its own marketing purposes. The customer always has the option of preventing this automatic evaluation. If no automatic personalized evaluation is desired at all, the customer can object in writing at any time.

10.2 The customer only receives a newsletter from LE MILK BAR at their express request. The customer can unsubscribe at any time.

11. Liability

11.1 Liability for product defects or damage caused by such defects is based exclusively on Section 7. For damage resulting from late delivery, Section 4 applies exclusively.

11.2 LE MILK BAR excludes any other liability to the customer in connection with the products, the use or the (non-)availability of the website LE MILK BAR within the scope of the legally permissible. For example, claims for damages due to impossibility of performance, non-performance and tort are excluded both against LE MILK BAR.

12. Partial invalidity & Validity Reduction

If a provision of these terms and conditions should be invalid in whole or in part, this has no effect on the validity of the remaining provisions and their purpose. The relevant statutory provisions shall apply in place of the invalid provisions.

13. Governing Law & Jurisdiction

The contract is exclusively subject to Swiss law. Place of jurisdiction for all disputes with LE MILK BAR is - subject to deviating mandatory places of jurisdiction under federal law - Geneva, Switzerland.

14. Changes to the terms and conditions

LE MILK BAR expressly reserves the right to adapt these general terms and conditions to the circumstances at any time and to apply them immediately to subsequent orders.
